RAFA MEDIA TERMS & CONDITIONS AGREEMENT
This Terms of Service Agreement (the “Agreement” or “Terms”) is a legally binding contract between you (“User,” “you,” or “your”) and Rafa Media, LLC (together with its affiliates, “Rafa Media,” “Company,” “we,” “us,” or “our”), a company located in Dalton, Georgia, United States. By downloading, installing, accessing, or using the Rafa mobile application (the “App”) or any related services, websites, or features (collectively, the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of the Service and uninstall the App.

Acceptance of Terms: Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. We may update these Terms from time to time. Continued use of the Service after any modifications constitutes your acceptance of the revised Terms.
By downloading, accessing, or using Rafa, you confirm that you are at least 16 years old and agree to abide by these Terms and all applicable laws. If you do not agree, please do not use our services.
Description of Service RC Event Hub is a mobile app that allows users to discover, track, and join RC (Remote Control) events including races, fun-flys, swap meets, and expos. We also offer giveaway promotions and advertising opportunities for RC brands and event organizers.
2. Description of Service
Rafa is a mobile app that allows users to find new people, and discover and create local interest based groups.
3. ELIGIBILITY
You must be at least 16 years old to use Rafa Media. If you are under 18 you represent that you have permission from a parent or legal guardian.
4. USER ACCOUNTS
To access certain features, you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain the confidentiality of your login credentials
- Accept responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
5. USER CONTENT
(“User Content”), including text, images, videos, groups and other materials.
By posting content, you grant Rafa Media a worldwide, non-exclusive, royalty-free license to:
- Use, host, display, reproduce, and distribute your content
- Promote and improve the Service
You agree not to post content that:
- Is unlawful, harmful, defamatory, obscene, or abusive
- Promotes hate, harassment, or violence
- Violates intellectual property or privacy rights
- Is inconsistent with the values as determined by Rafa Media
We reserve the right to remove any content at our discretion.

6. PROHIBITED CONDUCT
You agree not to:
- Use the Service for illegal or ill purposes
- Impersonate others or misrepresent your identity
- Attempt to gain unauthorized access to systems or accounts
- Distribute spam, malware, or harm
- Use the app in any way that offends our policy
- Exploit or harm to anyone, including minors
Violation may result in immediate termination and legal action.

7. CONDUCT ENFORCEMENT AND MONETARY PENALTIES
Rafa Media maintains a faith-based standard of conduct aligned with its mission. Certain behaviors or content may be deemed illegal under our internal guidelines and interpretations of biblical principles.
By agreeing to these Terms, you acknowledge and agree that:
- Rafa Media reserves the right, in its sole discretion, to determine whether conduct constitutes to a violation of our values.
- In cases of severe or repeated violations, Rafa Media may impose a monetary penalty (“Conduct Fee”) of up to $50,000 USD per violation.
- The amount of any Conduct Fee will be determined based on the nature, severity, frequency, and\or impact of the violation.
- You agree to pay any assessed Conduct Fee within the timeframe specified by Rafa Media which will be notified to you.
- Rafa Media reserves the right to pursue collection of unpaid fees through lawful means.
In addition to monetary penalties, Rafa Media may also suspend or terminate accounts and remove content.

8. PRIVACY
Your use of Rafa Media is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein.
9. INTELLECTUAL PROPERTY
All content and materials provided by Rafa Media are owned by or licensed to us and are protected by intellectual property laws.
You may not:
- Copy, modify, or distribute our content without permission
- Reverse engineer or attempt to extract source code
10. COMMUNITY GUIDELINES
We are committed to fostering a safe and uplifting community. Users must:
- Communicate with kindness and respect
- Avoid divisive or harmful disputes
- Refrain from harassment, bullying, or intimidation, or lies
We may moderate, remove, or restrict content or users that violate these principles.

11. TERMINATION
We may suspend or terminate your access to Rafa Media at any time, with or without notice, if you violate these Terms or for any other reason at our discretion.
Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account and content

12. DISCLAIMERS
Rafa Media is provided “AS IS” and “AS AVAILABLE.”
We do not guarantee:
- Continuous or error-free operation
- Accuracy or reliability of content
- That the Service will meet your expectations
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Rafa Media shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or goodwill
- Damages arising from your use or inability to use the Service
14. INDEMNIFICATION
You agree to indemnify and hold harmless Rafa Media and its affiliates from any claims, damages, or expenses arising from:
- Your use of the Service

20. ENTIRE AGREEMENT
These Terms, along with the EULA, and along with every prior agreement constitute the entire agreement between you and Rafa Media regarding the Service.
21. ACKNOWLEDGMENT
By using Rafa Media, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
22. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
